These Terms of Service (“Terms“) govern your access to and use of the Total Teck website, including totalteck.net, its pages, subdomains, and other websites or online services operated by Total Teck that link to these Terms (collectively, the “Website“).

These Terms also establish general conditions applicable to products and services offered by Total Teck, LLC (“Total Teck,” “Company,” “we,” “us,” or “our“), except where different or additional terms are established in a separate written agreement between Total Teck and a client.

By accessing or using the Website, submitting a request for services, purchasing services, or otherwise engaging with Total Teck, you acknowledge that you have read and understood these Terms and agree to be bound by them to the extent applicable.

If you do not agree with these Terms, you should not use the Website.


1. Relationship Between These Terms and Client Agreements

These Terms establish general rules governing the Website and Total Teck’s services.

Many Total Teck clients enter into separate written agreements, proposals, statements of work, service agreements, hosting agreements, project authorizations, change orders, or similar documents (collectively, “Client Agreements“).

If a provision of these Terms conflicts with a provision contained in a Client Agreement executed or otherwise formally accepted by Total Teck and the applicable client, the Client Agreement will control with respect to that conflict.

Nothing contained in these Website Terms is intended to modify, replace, expand, or override the specific pricing, deliverables, payment schedules, project terms, ownership provisions, cancellation provisions, warranties, responsibilities, or other conditions established in an applicable Client Agreement.


2. About Total Teck

Total Teck provides professional digital services to businesses and organizations.

Services may include, without limitation:

  • Custom website design.

  • Website development.

  • WordPress development.

  • eCommerce development.

  • Custom web applications.

  • Website hosting.

  • Website security.

  • Website maintenance and support.

  • Search Engine Optimization (“SEO”).

  • Answer Engine Optimization (“AEO”).

  • Generative Engine Optimization (“GEO”).

  • Content development.

  • Blog writing.

  • Graphic creation.

  • Digital strategy.

  • Website integrations.

  • Artificial intelligence integrations.

  • Website AI assistants.

  • AI phone assistants.

  • Automation services.

  • Analytics and related technologies.

  • Consulting.

  • Other custom digital services.

Specific services provided to a client are determined by the applicable Client Agreement.


3. Acceptance of Terms

By accessing or using the Website, you represent that:

  • You are legally capable of entering into a binding agreement.

  • You will use the Website in accordance with applicable law.

  • Information you provide to Total Teck is accurate to the best of your knowledge.

  • You will not use the Website for unlawful or prohibited purposes.

If you use the Website or engage Total Teck on behalf of a business, organization, or other entity, you represent that you have authority to act on behalf of that entity.


4. Website Use

Total Teck grants Website visitors a limited, revocable, non-exclusive, non-transferable right to access and use the Website for legitimate informational and business purposes.

This permission does not transfer ownership of any Website content, intellectual property, software, design, code, graphics, trademarks, or other materials.

Total Teck may modify, restrict, suspend, or discontinue any portion of the Website at any time.


5. Services and Project Scope

Descriptions of services appearing on the Website are provided for general informational and marketing purposes.

Website descriptions do not necessarily represent the exact services, functionality, features, deliverables, schedule, or pricing applicable to a particular client project.

The definitive scope of a client project will be established through the applicable Client Agreement.

Services or functionality not expressly included in an applicable Client Agreement may be considered outside the project’s original scope and may require additional fees.


6. Proposals, Estimates, and Quotes

Total Teck may provide proposals, estimates, quotes, or preliminary pricing based on information available at the time.

Unless expressly stated otherwise, quotes and estimates may be subject to:

  • Changes in project scope.

  • Additional client requests.

  • Third-party costs.

  • Technical requirements discovered during development.

  • Additional integrations.

  • Additional content.

  • Additional revisions.

  • Changes requested after approval.

  • Other circumstances affecting the amount of work required.

The applicable Client Agreement will govern final pricing and payment obligations.


7. Client Responsibilities

Successful completion of digital projects frequently requires timely cooperation from the client.

Clients may be responsible for providing items including:

  • Content.

  • Images.

  • Logos.

  • Brand assets.

  • Product information.

  • Pricing information.

  • Business information.

  • Domain access.

  • Hosting access.

  • Website credentials.

  • API credentials.

  • Third-party account access.

  • Approval of designs.

  • Feedback.

  • Legal policies.

  • Necessary authorizations.

  • Other materials reasonably required for the project.

Clients are responsible for ensuring that information and materials supplied to Total Teck are accurate and that they have the legal right to use and provide those materials.


8. Client Delays and Project Timelines

Project schedules may depend upon timely client communication, approvals, content delivery, access credentials, and other client responsibilities.

Total Teck is not responsible for delays caused by:

  • Delayed client responses.

  • Missing content.

  • Missing credentials.

  • Delayed approvals.

  • Scope changes.

  • Third-party vendors.

  • Hosting providers.

  • Domain providers.

  • Software providers.

  • API providers.

  • Internet outages.

  • Platform changes.

  • Events outside Total Teck’s reasonable control.

Client-caused delays may result in project schedule adjustments.

Any specific timeline commitments contained in an applicable Client Agreement will control.


9. Revisions and Change Requests

Projects may include a specified number or scope of revisions as established in the applicable Client Agreement.

Requests exceeding the agreed scope may be considered additional work and may require:

  • Additional development fees.

  • Additional hourly charges.

  • A change order.

  • A revised proposal.

  • Additional project time.

Total Teck is not obligated to perform services outside an agreed scope without additional authorization or compensation.


10. Client Approvals

Total Teck may request approval of designs, layouts, content, functionality, development milestones, or other project elements.

Once an item has been approved, substantial changes to the approved item may constitute additional work.

Clients are responsible for carefully reviewing materials before approval, including:

  • Spelling.

  • Contact information.

  • Pricing.

  • Product information.

  • Legal statements.

  • Images.

  • Business information.

  • Links.

  • Functionality.

  • Other client-specific information.

Final approval constitutes authorization to proceed unless otherwise provided by the applicable Client Agreement.


11. Fees and Payment

Clients agree to pay all fees associated with products and services ordered from Total Teck according to the applicable invoice, proposal, Client Agreement, subscription, or other purchasing arrangement.

Depending on the engagement, Total Teck may require:

  • Deposits.

  • Progress payments.

  • Milestone payments.

  • Final payments.

  • Monthly recurring payments.

  • Annual payments.

  • Hourly charges.

  • Third-party expenses.

Payment requirements established in a Client Agreement will control.

Failure to pay amounts when due may result in suspension or termination of services as permitted by the applicable agreement and law.


12. ALL SALES ARE FINAL – NO REFUNDS

ALL SALES WITH TOTAL TECK ARE FINAL UNLESS A CLIENT AGREEMENT EXPRESSLY STATES OTHERWISE IN WRITING.

Payments made for Total Teck products or services are non-refundable, including payments relating to:

  • Deposits.

  • Website design.

  • Website development.

  • Custom development.

  • eCommerce development.

  • Web applications.

  • SEO services.

  • AEO services.

  • GEO services.

  • Content creation.

  • Graphic creation.

  • Consulting.

  • Hosting.

  • Maintenance.

  • Security services.

  • AI assistants.

  • AI integrations.

  • Software configuration.

  • Monthly services.

  • Annual services.

  • Setup fees.

  • Custom programming.

  • Third-party configuration.

  • Other professional services.

Because Total Teck allocates personnel, development resources, server resources, scheduling capacity, software resources, and other costs after a project or service is authorized, payments are generally not refundable once made.

There are no prorated refunds for partially used subscription periods or monthly services.

If a Client Agreement expressly provides different refund terms, that Client Agreement controls.


13. Deposits and Project Payments

Where a deposit or initial payment is required, work may not begin until the required payment has been received.

Deposits and project payments compensate Total Teck for reserved production capacity, planning, strategy, design, development, administration, and other resources committed to the project.

Unless expressly stated otherwise in a Client Agreement, deposits and project payments are non-refundable.

Cancellation of a project does not automatically eliminate amounts already owed for services performed, resources committed, third-party expenses incurred, or other amounts due under the applicable Client Agreement.


14. Recurring and Monthly Services

Certain Total Teck services may be provided on a recurring basis, including:

  • Website hosting.

  • Website maintenance.

  • Website security.

  • SEO.

  • AEO.

  • GEO.

  • Content services.

  • AI assistants.

  • AI phone services.

  • Support plans.

  • Software-related services.

  • Other recurring digital services.

Recurring services may automatically renew and continue to be billed until properly canceled in accordance with these Terms or the applicable Client Agreement.


15. Cancellation of Monthly Services

Unless an applicable Client Agreement provides different cancellation terms, monthly recurring services require at least thirty (30) days’ written notice of cancellation.

Cancellation requests must be submitted in writing.

Written cancellation may be submitted by email to:

support@totalteck.net

The cancellation request should clearly identify:

  • The client’s name.

  • Business name.

  • Service being canceled.

  • Website or account involved.

  • Requested cancellation.

Verbal requests, telephone conversations, text messages, or informal discussions do not constitute formal cancellation unless Total Teck expressly confirms otherwise in writing.

Services remain active and billable during the required notice period.

Because all sales are final, payments already processed are non-refundable and will not be prorated.

If the client’s signed agreement establishes a different notice period or cancellation procedure, the signed agreement controls.


16. Automatic Renewal

Recurring services may automatically renew for successive billing periods until canceled according to the applicable cancellation requirements.

Clients are responsible for submitting cancellation requests sufficiently in advance of the next billing cycle.

Failure to provide the required notice may result in another billing period becoming due.

Renewal charges are subject to the all-sales-final policy unless otherwise expressly established in a Client Agreement or required by applicable law.


17. Suspension for Nonpayment

Total Teck may suspend services when an account becomes past due, subject to applicable contractual and legal requirements.

Suspended services may include:

  • Website hosting.

  • Maintenance.

  • Security.

  • Support.

  • AI assistants.

  • Software.

  • Integrations.

  • Development.

  • SEO-related services.

  • Other recurring or ongoing services.

Total Teck is not responsible for losses resulting from a service suspension caused by a client’s failure to satisfy payment obligations.

Reactivation may be subject to outstanding balances and applicable reactivation or administrative fees.


18. Website Hosting

When Total Teck provides website hosting, the service may rely upon servers, data centers, networks, DNS providers, security providers, content delivery networks, software, and other third-party infrastructure.

Total Teck will use commercially reasonable efforts to provide reliable hosting but cannot guarantee uninterrupted availability.

Temporary downtime may occur because of:

  • Server maintenance.

  • Software updates.

  • Security incidents.

  • Network failures.

  • Third-party outages.

  • DNS failures.

  • Cyberattacks.

  • Hardware failures.

  • Emergency maintenance.

  • Events outside Total Teck’s reasonable control.

Any specific hosting commitments contained in a Client Agreement will control.


19. Website Security and Cybersecurity

Total Teck may provide security measures intended to reduce website risks.

However, no website, server, application, network, security system, firewall, plugin, backup, or cybersecurity solution can guarantee complete protection against every threat.

Total Teck does not guarantee that a website will never experience:

  • Malware.

  • Hacking.

  • Unauthorized access.

  • Data breaches.

  • Distributed denial-of-service attacks.

  • Software vulnerabilities.

  • Spam.

  • Credential compromise.

  • Third-party security incidents.

  • Other cyber threats.

Clients remain responsible for protecting account credentials and promptly informing Total Teck of suspected security incidents affecting services we provide.


20. Backups and Data Recovery

Total Teck may maintain backups as part of certain hosting or maintenance services.

Backups are a risk-reduction measure and are not a guarantee against every form of data loss.

Unless expressly guaranteed in a Client Agreement, Total Teck does not warrant that every backup will:

  • Be available.

  • Contain every file.

  • Contain the most recent data.

  • Restore without error.

  • Preserve third-party systems or externally stored information.

Clients should maintain independent copies of business-critical information when appropriate.


21. Website Transfer and File Transfer Fees

Clients may request the transfer, packaging, migration, export, or delivery of website files, databases, configurations, or other technical assets.

Website and file transfers are not automatically included with every Total Teck service and may be subject to a transfer, migration, administrative, preparation, or technical service fee.

Fees may apply to work required to:

  • Prepare website files.

  • Package website files.

  • Export databases.

  • Prepare backups.

  • Transfer files to another hosting provider.

  • Migrate websites.

  • Configure destination environments.

  • Transfer DNS information.

  • Coordinate with another developer or provider.

  • Provide technical assistance during migration.

  • Perform troubleshooting associated with a transfer.

The amount of any applicable fee may depend upon the complexity and time required.

Payment of all outstanding amounts owed to Total Teck may be required before transfer services are performed or files are released, to the extent permitted by the applicable Client Agreement and law.

Nothing in this section changes intellectual-property ownership established in a Client Agreement.


22. Domains and Third-Party Accounts

Total Teck may assist clients with domains, hosting accounts, software licenses, advertising accounts, analytics accounts, email services, or other third-party platforms.

Ownership and control of these resources may depend upon:

  • Who purchased the resource.

  • The account under which it was registered.

  • Third-party terms.

  • Licensing restrictions.

  • The applicable Client Agreement.

Clients are responsible for maintaining accurate account and billing information with third-party providers when accounts are registered directly to them.


23. Third-Party Software, Plugins, APIs, and Services

Modern websites and digital services frequently depend on third-party technologies.

Total Teck may integrate or configure services including:

  • WordPress.

  • Plugins.

  • Payment gateways.

  • CRM platforms.

  • APIs.

  • Scheduling systems.

  • Analytics platforms.

  • Advertising platforms.

  • eCommerce software.

  • AI providers.

  • Email systems.

  • Security systems.

  • Hosting platforms.

  • Social media integrations.

  • Other external technologies.

Third-party providers may modify pricing, features, APIs, functionality, policies, availability, or technical requirements without Total Teck’s control.

Total Teck is not responsible for failures, changes, outages, discontinued services, policy changes, security incidents, or other actions attributable to independent third-party providers.


24. Third-Party Fees and Licenses

Certain projects may require paid third-party products or services.

Examples may include:

  • Premium plugins.

  • Software subscriptions.

  • Fonts.

  • Stock photography.

  • APIs.

  • Hosting.

  • Domain registration.

  • Payment gateways.

  • CRM systems.

  • AI platforms.

  • Email services.

  • Advertising platforms.

Unless expressly included in a Client Agreement, third-party costs may be the client’s responsibility.

Third-party pricing may change independently of Total Teck.


25. Client-Provided Content and Materials

Clients represent and warrant that they have sufficient rights, permissions, licenses, and authority to provide all content and materials submitted to Total Teck.

This includes:

  • Text.

  • Images.

  • Photography.

  • Videos.

  • Logos.

  • Trademarks.

  • Product information.

  • Customer information.

  • Fonts.

  • Documents.

  • Data.

  • Music.

  • Graphics.

  • Other intellectual property.

Total Teck may rely upon the client’s representation that the client is legally authorized to use these materials.

The client is responsible for claims arising from materials supplied by the client, subject to the terms of the applicable Client Agreement and applicable law.


26. Intellectual Property and Website Ownership

Ownership of custom website designs, development work, code, graphics, content, or other project deliverables will be determined by the applicable Client Agreement.

Nothing in these Website Terms is intended to change ownership rights expressly established in a Client Agreement.

Total Teck may retain ownership of its pre-existing materials, proprietary tools, development methods, frameworks, reusable code, processes, libraries, systems, templates, know-how, and other intellectual property developed independently of a particular client engagement, unless otherwise agreed in writing.

Third-party intellectual property remains subject to the rights and licenses of the applicable third-party owner.


27. Total Teck Website Content

Unless otherwise indicated, the Total Teck Website and its original content are owned by or licensed to Total Teck and are protected by applicable intellectual-property laws.

Protected materials may include:

  • Website copy.

  • Graphics.

  • Logos.

  • Branding.

  • Layouts.

  • Designs.

  • Videos.

  • Animations.

  • Code.

  • Images.

  • Case studies.

  • Articles.

  • Software.

  • Other original content.

Website visitors may not reproduce, republish, distribute, sell, modify, scrape, commercially exploit, or create derivative works from Total Teck Website content without authorization.


28. Portfolio and Project Display

Total Teck may display completed work, project names, screenshots, links, or descriptions in its portfolio, case studies, presentations, social media, proposals, or marketing materials when permitted by the applicable Client Agreement and law.

Any confidentiality, nondisclosure, white-label, agency-partnership, or portfolio restrictions contained in an applicable Client Agreement will control over this provision.


29. Search Optimization and Marketing Results

SEO, AEO, GEO, digital marketing, content strategy, and similar services involve numerous factors outside Total Teck’s control.

Total Teck does not guarantee:

  • Specific search rankings.

  • First-page placement.

  • Number-one rankings.

  • Search-engine indexing.

  • AI citation or inclusion.

  • AI-generated recommendations.

  • Specific traffic levels.

  • Leads.

  • Sales.

  • Revenue.

  • Conversion rates.

  • Advertising results.

  • Business growth.

Search engines, AI platforms, algorithms, competitors, market conditions, user behavior, and third-party platforms may change without notice.

Total Teck will perform agreed services but cannot guarantee a particular commercial outcome.


30. Artificial Intelligence Services

Total Teck may provide AI-related services, including website assistants, AI phone assistants, conversational systems, automated responses, AI integrations, and other AI-enabled technologies.

Artificial intelligence systems are probabilistic technologies and may occasionally generate:

  • Incorrect information.

  • Incomplete information.

  • Unexpected responses.

  • Misinterpretations.

  • Inconsistent responses.

Clients are responsible for reviewing the appropriateness of AI functionality for their business and informing Total Teck of material inaccuracies requiring correction.

Total Teck does not guarantee that an AI system will produce error-free responses in every interaction.

AI services may also depend upon third-party AI providers, telecommunications providers, APIs, hosting infrastructure, or other external technologies.


31. Legal Compliance and Client Responsibility

Total Teck provides website design, development, technology, and digital services and does not act as a client’s attorney or legal compliance advisor unless expressly stated otherwise.

Clients are ultimately responsible for determining the legal requirements applicable to their businesses and websites.

This may include requirements relating to:

  • Privacy.

  • Cookies.

  • Accessibility.

  • Advertising.

  • Industry regulations.

  • eCommerce.

  • Consumer disclosures.

  • Terms and conditions.

  • Email marketing.

  • Text messaging.

  • Intellectual property.

  • Data collection.

  • Industry-specific regulations.

When Total Teck provides or assists with policies, banners, accessibility technologies, or compliance-related functionality, such services are intended to support the client’s compliance efforts and do not constitute a guarantee of legal compliance.

Clients should obtain qualified legal advice regarding requirements applicable to their businesses.


32. Accessibility

Total Teck may implement accessibility practices or third-party accessibility technologies when included in a project’s scope.

No website design technique, automated accessibility application, plugin, overlay, or software product can guarantee permanent or complete compliance with every accessibility requirement.

Websites change over time as content, plugins, integrations, technologies, and standards evolve.

Clients remain responsible for determining and maintaining accessibility requirements applicable to their organizations unless otherwise expressly agreed in writing.


33. Prohibited Website Use

Users may not use the Total Teck Website to:

  • Violate applicable law.

  • Attempt unauthorized access.

  • Introduce malware or malicious code.

  • Interfere with Website operation.

  • Circumvent security systems.

  • Scrape Website content without authorization.

  • Harvest personal information.

  • Impersonate another person or business.

  • Submit fraudulent information.

  • Infringe intellectual-property rights.

  • Engage in abusive or threatening conduct.

  • Conduct unauthorized automated activity.

  • Attempt to reverse engineer protected systems.

  • Use Total Teck intellectual property for unauthorized commercial purposes.

Total Teck may restrict access where misuse is suspected.


34. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TOTAL TECK DOES NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE:

  • UNINTERRUPTED.

  • ERROR-FREE.

  • COMPLETELY SECURE.

  • FREE OF HARMFUL COMPONENTS.

  • AVAILABLE AT ALL TIMES.

  • COMPATIBLE WITH EVERY DEVICE OR SOFTWARE CONFIGURATION.

Services provided to clients are subject to the warranties, if any, expressly contained in the applicable Client Agreement.

No statement on the Website creates an additional warranty that contradicts or expands an applicable Client Agreement.


35. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOTAL TECK AND ITS OWNERS, MEMBERS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE WEBSITE OR SERVICES, INCLUDING LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITY, GOODWILL, OR DATA.

TOTAL TECK WILL NOT BE RESPONSIBLE FOR LOSSES CAUSED BY EVENTS OUTSIDE ITS REASONABLE CONTROL, INCLUDING THIRD-PARTY PLATFORM FAILURES, CYBERATTACKS, HOSTING OUTAGES, DOMAIN FAILURES, API CHANGES, SOFTWARE FAILURES, SEARCH-ENGINE CHANGES, AI PLATFORM CHANGES, OR CLIENT ACTIONS.

Where applicable, limitations or allocations of liability contained in an applicable Client Agreement will control with respect to services performed under that agreement.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.


36. Indemnification

To the extent permitted by applicable law and subject to any applicable Client Agreement, users and clients agree to indemnify and hold harmless Total Teck and its owners, employees, contractors, and representatives from third-party claims arising from:

  • Unlawful use of the Website.

  • Materials supplied by the client without proper authorization.

  • Client infringement of third-party rights.

  • Client misuse of delivered services.

  • Client violations of applicable law.

  • Client modifications made after delivery.

  • Client products, services, representations, or business practices.

Any indemnification obligations contained in an applicable Client Agreement will control with respect to the applicable engagement.


37. Termination and Refusal of Service

Total Teck reserves the right to refuse, suspend, or terminate services where reasonably necessary, including because of:

  • Nonpayment.

  • Material breach of an agreement.

  • Fraud.

  • Illegal activity.

  • Abuse of employees or contractors.

  • Security threats.

  • Misuse of Total Teck systems.

  • Repeated failure to cooperate with reasonable project requirements.

Termination does not automatically eliminate outstanding payment obligations.

Termination of recurring services remains subject to applicable cancellation requirements unless termination is initiated by Total Teck or otherwise governed by a Client Agreement.


38. Privacy

Use of the Website is also subject to the Total Teck Privacy Policy.

The Privacy Policy describes how Total Teck may collect, use, disclose, store, and otherwise process personal information.

The Privacy Policy should be read together with these Terms where applicable.


39. Release and Waiver of Claims

To the maximum extent permitted by applicable law, you agree that you will not bring, maintain, or pursue any claim, lawsuit, or other legal action against Total Teck, its owners, members, employees, contractors, representatives, or affiliates arising from losses, damages, interruptions, errors, failures, or other matters that are expressly disclaimed, assumed by the client, or limited under these Terms or an applicable Client Agreement.

You acknowledge that Total Teck provides digital, technology, hosting, marketing, and related services that may depend upon third-party platforms, software, hosting providers, APIs, artificial intelligence systems, search engines, internet infrastructure, and other technologies outside Total Teck’s direct control. You therefore release and waive claims against Total Teck arising solely from circumstances outside Total Teck’s reasonable control, to the fullest extent permitted by law.

Nothing in this section waives any right or remedy that cannot legally be waived. If an applicable signed Client Agreement provides different dispute, liability, or claims provisions, that Client Agreement will control.


40. Governing Law, Venue, and Jurisdiction

These Terms and any dispute, claim, or controversy arising out of or relating to the Website, services provided by Total Teck, or these Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law principles.

You agree that any legal action, lawsuit, or proceeding arising out of or relating to these Terms or the services provided by Total Teck shall be brought exclusively in the state or federal courts located in Allen County, Indiana, and you hereby consent to the personal jurisdiction of such courts.

By using the Website or engaging Total Teck for services, you waive any objection to venue or jurisdiction in Allen County, Indiana, including any claim that such forum is inconvenient.


41.  Severability, Waiver, and Entire Agreement

These Terms will be governed by the laws applicable to Total Teck as established under applicable law, without regard to conflict-of-law principles.

Any specific governing-law, venue, arbitration, mediation, or dispute-resolution provision contained in a Client Agreement will control for disputes arising from that agreement.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by law.

Total Teck’s failure to enforce a provision on one occasion does not constitute a permanent waiver of that provision or the right to enforce it later.

For clients operating under a Client Agreement, these Terms supplement rather than replace the Client Agreement. If the documents conflict, the Client Agreement controls as provided in Section 1.

Total Teck may update these Terms periodically to reflect changes in its services, technologies, business practices, or applicable law. The “Last Updated” date will identify the most recent revision.
